《青島市軌道交通建設管理辦法》將于3月1日起實施

  為保障軌道交通(tong)(tong)(tong)建設項目的順利(li)推(tui)進(jin),規范解(jie)決軌道交通(tong)(tong)(tong)沿線(xian)用地(di)控制、管線(xian)遷(qian)移、房屋征收以(yi)及資金投(tou)入(ru)、使(shi)用管理和相關單位配合等一系列問題,經市有關部 門三年多的努力,《青島市軌道交通(tong)(tong)(tong)建設管理辦法(fa)》(以(yi)下簡稱《辦法(fa)》)已經頒布,將于2014年3月1日(ri)起正式施行(xing)。現就《辦法(fa)》中相關內容(rong)進(jin)行(xing)詳細解(jie)讀:

解(jie)讀一:

  重在規(gui)范建設(she)行(xing)為

  明確各項防護(hu)規定 

  設(she)計(ji)施(shi)(shi)工(gong)(gong)(gong)保(bao)護:《辦法》分別(bie)對(dui)初步設(she)計(ji)和(he)(he)施(shi)(shi)工(gong)(gong)(gong)中(zhong)應當(dang)采(cai)取(qu)的保(bao)護措施(shi)(shi)提出了要(yao)求(qiu),“軌道交通建設(she)項(xiang)(xiang)目初步設(she)計(ji)前(qian),軌道交通建設(she)單(dan)位應當(dang)對(dui)軌道交通建設(she)項(xiang)(xiang)目 周(zhou)邊已有(you)建筑(zhu)物、構筑(zhu)物、管線(xian)、市政基礎(chu)設(she)施(shi)(shi)等進(jin)行調(diao)查和(he)(he)記錄”,并(bing)規定建設(she)期間(jian)采(cai)取(qu)措施(shi)(shi),防止(zhi)和(he)(he)減少施(shi)(shi)工(gong)(gong)(gong)對(dui)沿線(xian)相關設(she)施(shi)(shi)的影(ying)響(xiang)。

  周邊環(huan)境保護(hu):結合其(qi)他地(di)(di)(di)鐵城市(shi)(shi)相(xiang)關(guan)經(jing)驗,地(di)(di)(di)鐵線(xian)路(lu)經(jing)過的(de)(de)大多是人員眾多、道路(lu)狹窄、商(shang)戶(hu)云集、居(ju)民(min)住(zhu)(zhu)宅(zhai)(zhai)密布的(de)(de)地(di)(di)(di)區,不(bu)(bu)可避免的(de)(de)會(hui)對周邊商(shang)戶(hu)和居(ju)民(min)住(zhu)(zhu)戶(hu) 造成(cheng)(cheng)一定(ding)程度(du)的(de)(de)影(ying)響(xiang),我市(shi)(shi)也(ye)不(bu)(bu)例外(wai)。如何最大限度(du)地(di)(di)(di)把(ba)地(di)(di)(di)鐵建(jian)(jian)設(she)(she)對周邊居(ju)民(min)住(zhu)(zhu)宅(zhai)(zhai)、商(shang)戶(hu)經(jing)營的(de)(de)影(ying)響(xiang)降至最低(di),也(ye)是《辦法(fa)(fa)》重點(dian)考慮的(de)(de)事項。因此,《辦法(fa)(fa)》規(gui) 定(ding),軌道交(jiao)(jiao)通(tong)建(jian)(jian)設(she)(she)期間,軌道交(jiao)(jiao)通(tong)施(shi)工單位對因建(jian)(jian)設(she)(she)工程施(shi)工可能造成(cheng)(cheng)損害的(de)(de)毗(pi)鄰(lin)建(jian)(jian)筑物(wu)、構筑物(wu)和地(di)(di)(di)下管(guan)線(xian)等,應(ying)當采取專項防護(hu)措(cuo)施(shi)。

  道路(lu)(lu)交(jiao)(jiao)通(tong)(tong)保護:軌道交(jiao)(jiao)通(tong)(tong)建(jian)(jian)(jian)(jian)(jian)設(she)(she)(she)(she)期間,軌道交(jiao)(jiao)通(tong)(tong)建(jian)(jian)(jian)(jian)(jian)設(she)(she)(she)(she)單(dan)位(wei)(wei)應當結合工程對交(jiao)(jiao)通(tong)(tong)、周邊(bian)居民出行(xing)以及重要場(chang)所(suo)、建(jian)(jian)(jian)(jian)(jian)筑(zhu)物(wu)和構(gou)筑(zhu)物(wu)等(deng)的(de)影(ying)響,提(ti)出占(zhan)(zhan)路(lu)(lu)調流(liu)(liu)方(fang)(fang)案(an)(an),報市城 鄉建(jian)(jian)(jian)(jian)(jian)設(she)(she)(she)(she)行(xing)政(zheng)(zheng)主管(guan)部門。市城鄉建(jian)(jian)(jian)(jian)(jian)設(she)(she)(she)(she)行(xing)政(zheng)(zheng)主管(guan)部門應當組(zu)織公(gong)安交(jiao)(jiao)通(tong)(tong)管(guan)理(li)等(deng)部門,對占(zhan)(zhan)路(lu)(lu)調流(liu)(liu)方(fang)(fang)案(an)(an)進行(xing)核(he)查(cha)和研(yan)究(jiu)(jiu),并按程序(xu)批準(zhun)后實施(shi)。建(jian)(jian)(jian)(jian)(jian)設(she)(she)(she)(she)單(dan)位(wei)(wei)在召集相關參建(jian)(jian)(jian)(jian)(jian)單(dan) 位(wei)(wei)制(zhi)定占(zhan)(zhan)路(lu)(lu)調流(liu)(liu)方(fang)(fang)案(an)(an)時,遵循在保證(zheng)施(shi)工的(de)前提(ti)下(xia),最大(da)限度地減少建(jian)(jian)(jian)(jian)(jian)設(she)(she)(she)(she)對交(jiao)(jiao)通(tong)(tong)影(ying)響的(de)原則進行(xing)相關工作,保證(zheng)發揮道路(lu)(lu)通(tong)(tong)行(xing)的(de)最大(da)效(xiao)能(neng)。制(zhi)定好道路(lu)(lu)調流(liu)(liu)方(fang)(fang)案(an)(an)后, 還要報市城鄉建(jian)(jian)(jian)(jian)(jian)設(she)(she)(she)(she)行(xing)政(zheng)(zheng)主管(guan)部門,由其會同公(gong)安交(jiao)(jiao)通(tong)(tong)管(guan)理(li)部門進行(xing)核(he)查(cha)研(yan)究(jiu)(jiu),按程序(xu)批準(zhun)。

解讀二(er): 

  設置控制(zhi)保護區域

  保護施(shi)工乘(cheng)坐安全 

  為保(bao)障軌(gui)道(dao)交(jiao)(jiao)通建設(she)(she)(she)以及(ji)今(jin)后運營安全(quan),國(guo)(guo)家住建部和質監總局發布的(de)(de)《城(cheng)市軌(gui)道(dao)交(jiao)(jiao)通建設(she)(she)(she)項目管理(li)規范》規定,應在(zai)軌(gui)道(dao)交(jiao)(jiao)通建設(she)(she)(she)中(zhong)設(she)(she)(she)置規劃控(kong)制(zhi)區(qu)(qu)和特(te)(te)別(bie)保(bao)護(hu) 區(qu)(qu)。我市借鑒國(guo)(guo)內其他地鐵(tie)城(cheng)市的(de)(de)經驗,采用了(le)控(kong)制(zhi)保(bao)護(hu)區(qu)(qu)和特(te)(te)別(bie)保(bao)護(hu)區(qu)(qu)的(de)(de)概念(nian)。其中(zhong),控(kong)制(zhi)保(bao)護(hu)區(qu)(qu)是軌(gui)道(dao)交(jiao)(jiao)通建設(she)(she)(she)中(zhong)具(ju)有特(te)(te)定用途的(de)(de)需(xu)要保(bao)護(hu)和控(kong)制(zhi)范圍(wei)的(de)(de)區(qu)(qu)域, 控(kong)制(zhi)保(bao)護(hu)區(qu)(qu)內設(she)(she)(she)置特(te)(te)別(bie)保(bao)護(hu)區(qu)(qu),是保(bao)護(hu)軌(gui)道(dao)交(jiao)(jiao)通工程結(jie)構安全(quan)的(de)(de)最小要求距離,原(yuan)則上禁止一切會影響到結(jie)構安全(quan)的(de)(de)建設(she)(she)(she)活動。

  設施(shi)(shi)設備安全:《辦(ban)(ban)法(fa)(fa)》規(gui)定設立軌(gui)道(dao)(dao)交通(tong)控制保(bao)護(hu)區和(he)特別保(bao)護(hu)區,并分(fen)別規(gui)定控制保(bao)護(hu)區和(he)特別保(bao)護(hu)區的(de)(de)(de)保(bao)護(hu)范圍和(he)具體的(de)(de)(de)保(bao)護(hu)措施(shi)(shi);對(dui)在(zai)保(bao)護(hu)區內進(jin)行(xing)(xing)作(zuo)業 的(de)(de)(de),《辦(ban)(ban)法(fa)(fa)》規(gui)定,作(zuo)業單位(wei)應當(dang)在(zai)施(shi)(shi)工前會(hui)同軌(gui)道(dao)(dao)交通(tong)建設單位(wei)制定軌(gui)道(dao)(dao)交通(tong)設施(shi)(shi)保(bao)護(hu)方案。目的(de)(de)(de)就是在(zai)與其他建設行(xing)(xing)為互不影響的(de)(de)(de)前提(ti)下(xia),保(bao)證地鐵設施(shi)(shi)的(de)(de)(de)安 全,進(jin)而(er)保(bao)障(zhang)社會(hui)公(gong)眾在(zai)乘坐地鐵時的(de)(de)(de)安全。

  同時(shi),由于地鐵(tie)建設(she)的(de)(de)(de)特殊性,《辦法》借(jie)鑒外地經驗,按照(zhao)優先發(fa)展的(de)(de)(de)原則,規定(ding)“軌道交(jiao)通(tong)(tong)控制(zhi)保護區和(he)(he)特別保護區內的(de)(de)(de)各項建設(she),應當服從和(he)(he)配合軌道交(jiao)通(tong)(tong) 建設(she)。新建市政(zheng)基(ji)礎設(she)施(shi)、人防工程與軌道交(jiao)通(tong)(tong)建設(she)相沖(chong)突的(de)(de)(de),相關(guan)部門應當按照(zhao)軌道交(jiao)通(tong)(tong)建設(she)優先的(de)(de)(de)原則進行協(xie)調(diao)和(he)(he)處理。”這(zhe)一點(dian)也(ye)是(shi)基(ji)于地鐵(tie)設(she)施(shi)安全性考慮 進行規定(ding)的(de)(de)(de)。 

  居民(min)(min)房屋(wu)(wu)安(an)全:為特別保(bao)護(hu)居民(min)(min)房屋(wu)(wu)的(de)(de)安(an)全,《辦法》規定,因軌(gui)道交通建(jian)(jian)設(she)需(xu)要(yao)進入建(jian)(jian)筑(zhu)物(wu)、構(gou)筑(zhu)物(wu)或設(she)施內進行檢(jian)測和(he)(he)鑒定的(de)(de),應當提前告(gao)知(zhi)產權(quan)人或者使用 人,產權(quan)人或者使用人應當予以配(pei)合,同時因建(jian)(jian)設(she)工程施工可能造成(cheng)損害的(de)(de)毗(pi)鄰建(jian)(jian)筑(zhu)物(wu)、構(gou)筑(zhu)物(wu)和(he)(he)地下管線等,應當采(cai)取(qu)專項(xiang)防(fang)護(hu)措(cuo)施。

解(jie)讀(du)三:

  協調各(ge)方支(zhi)持配合

  充(chong)分保(bao)障公共利益

  軌(gui)道交(jiao)(jiao)(jiao)通(tong)建(jian)設(she)涉(she)及方方面面,需要各方面力量的(de)配合支持,《辦(ban)法》規定,任(ren)何單(dan)位和個人不得阻礙或者影響軌(gui)道交(jiao)(jiao)(jiao)通(tong)建(jian)設(she)。為強力推進地鐵建(jian)設(she)進程(cheng),市(shi)政府在 政府層面成立(li)了市(shi)地鐵工程(cheng)建(jian)設(she)指揮部,承擔(dan)統籌領導職(zhi)能,負(fu)責軌(gui)道交(jiao)(jiao)(jiao)通(tong)建(jian)設(she)的(de)組織、指揮、協(xie)調、監督工作(zuo)。同時要求,市(shi)城鄉建(jian)設(she)、發展改革、規劃、國土資 源、公安(an)、財政、審計、安(an)全生產監管(guan)、交(jiao)(jiao)(jiao)通(tong)、人防、城管(guan)執(zhi)法等部門應當按(an)照職(zhi)責做好軌(gui)道交(jiao)(jiao)(jiao)通(tong)建(jian)設(she)相關工作(zuo)。

  公(gong)(gong)共(gong)交(jiao)通(tong)(tong)(tong)銜接(jie):軌(gui)道(dao)(dao)交(jiao)通(tong)(tong)(tong)是(shi)城(cheng)市(shi)發展到一(yi)定(ding)階段的產物,與(yu)(yu)早期的城(cheng)市(shi)規(gui)(gui)劃(hua)(hua)(hua)(hua)、土(tu)地利用規(gui)(gui)劃(hua)(hua)(hua)(hua)、交(jiao)通(tong)(tong)(tong)規(gui)(gui)劃(hua)(hua)(hua)(hua)、城(cheng)市(shi)功能(neng)(neng)區規(gui)(gui)劃(hua)(hua)(hua)(hua)存(cun)在不(bu)同(tong)(tong)步、不(bu)和諧性(xing),但(dan)客(ke)觀上(shang)又要求 與(yu)(yu)相(xiang)(xiang)關規(gui)(gui)劃(hua)(hua)(hua)(hua)相(xiang)(xiang)銜接(jie)。為(wei)此,《辦法》明確(que)要求,編制軌(gui)道(dao)(dao)交(jiao)通(tong)(tong)(tong)規(gui)(gui)劃(hua)(hua)(hua)(hua)應(ying)(ying)當合(he)理安排軌(gui)道(dao)(dao)交(jiao)通(tong)(tong)(tong)不(bu)同(tong)(tong)線路(lu)(lu)之(zhi)間(jian)(jian),軌(gui)道(dao)(dao)交(jiao)通(tong)(tong)(tong)與(yu)(yu)城(cheng)市(shi)道(dao)(dao)路(lu)(lu)、鐵路(lu)(lu)、公(gong)(gong)路(lu)(lu)、航空、港口和其他公(gong)(gong)共(gong) 交(jiao)通(tong)(tong)(tong)之(zhi)間(jian)(jian)的換乘銜接(jie)。這就需要各交(jiao)通(tong)(tong)(tong)運輸單(dan)位與(yu)(yu)地鐵密切配合(he),規(gui)(gui)劃(hua)(hua)(hua)(hua)好(hao)、銜接(jie)好(hao)、建設好(hao)相(xiang)(xiang)應(ying)(ying)的功能(neng)(neng)設施(shi)。

  公(gong)共用(yong)(yong)地(di)(di)(di)(di)(di)(di)控制(zhi):為推進軌(gui)(gui)(gui)(gui)道(dao)(dao)交(jiao)(jiao)(jiao)通(tong)(tong)可持續發(fa)展(zhan),同時(shi)考(kao)慮(lv)到(dao)軌(gui)(gui)(gui)(gui)道(dao)(dao)交(jiao)(jiao)(jiao)通(tong)(tong)屬于公(gong)益性事業,建(jian)設(she)(she)用(yong)(yong)地(di)(di)(di)(di)(di)(di)和資源開發(fa)用(yong)(yong)地(di)(di)(di)(di)(di)(di)應當依法(fa)予以保(bao)障。特別(bie)是(shi)防止(zhi)用(yong)(yong)地(di)(di)(di)(di)(di)(di)控制(zhi)、儲(chu)(chu)備不及 時(shi)導致的影響建(jian)設(she)(she)工期等問(wen)題(ti),《辦法(fa)》參照寧波、重慶等地(di)(di)(di)(di)(di)(di)經(jing)驗,對(dui)軌(gui)(gui)(gui)(gui)道(dao)(dao)交(jiao)(jiao)(jiao)通(tong)(tong)建(jian)立(li)土(tu)地(di)(di)(di)(di)(di)(di)專項(xiang)儲(chu)(chu)備和劃撥制(zhi)度,預留軌(gui)(gui)(gui)(gui)道(dao)(dao)交(jiao)(jiao)(jiao)通(tong)(tong)設(she)(she)施(shi)用(yong)(yong)地(di)(di)(di)(di)(di)(di)以及換乘(cheng)樞紐、公(gong)交(jiao)(jiao)(jiao)車(che)站、停(ting) 車(che)場等公(gong)用(yong)(yong)設(she)(she)施(shi)用(yong)(yong)地(di)(di)(di)(di)(di)(di),軌(gui)(gui)(gui)(gui)道(dao)(dao)交(jiao)(jiao)(jiao)通(tong)(tong)設(she)(she)施(shi)用(yong)(yong)地(di)(di)(di)(di)(di)(di)與其他用(yong)(yong)地(di)(di)(di)(di)(di)(di)不能分(fen)割用(yong)(yong)地(di)(di)(di)(di)(di)(di)出讓等問(wen)題(ti)進行規范。為保(bao)證軌(gui)(gui)(gui)(gui)道(dao)(dao)交(jiao)(jiao)(jiao)通(tong)(tong)建(jian)設(she)(she)土(tu)地(di)(di)(di)(di)(di)(di)使(shi)(shi)(shi)用(yong)(yong),《辦法(fa)》確(que)立(li)了(le)軌(gui)(gui)(gui)(gui)道(dao)(dao)交(jiao)(jiao)(jiao)通(tong)(tong)建(jian)設(she)(she)使(shi)(shi)(shi)用(yong)(yong)地(di)(di)(di)(di)(di)(di)面(mian)以下(xia)(xia) 的空間(jian),不受其上(shang)方土(tu)地(di)(di)(di)(di)(di)(di)使(shi)(shi)(shi)用(yong)(yong)權的限制(zhi)的原則(ze)。根(gen)據這一(yi)原則(ze),對(dui)軌(gui)(gui)(gui)(gui)道(dao)(dao)交(jiao)(jiao)(jiao)通(tong)(tong)建(jian)設(she)(she)使(shi)(shi)(shi)用(yong)(yong)的地(di)(di)(di)(di)(di)(di)表(biao)、地(di)(di)(di)(di)(di)(di)上(shang)或(huo)者地(di)(di)(di)(di)(di)(di)下(xia)(xia)土(tu)地(di)(di)(di)(di)(di)(di),以及結合軌(gui)(gui)(gui)(gui)道(dao)(dao)交(jiao)(jiao)(jiao)通(tong)(tong)設(she)(she)施(shi)一(yi)并(bing)開發(fa)的地(di)(di)(di)(di)(di)(di)表(biao)、地(di)(di)(di)(di)(di)(di)上(shang)或(huo)者 地(di)(di)(di)(di)(di)(di)下(xia)(xia)空間(jian)的使(shi)(shi)(shi)用(yong)(yong)權、權屬登(deng)記等問(wen)題(ti)予以明確(que),進一(yi)步(bu)明確(que)了(le)對(dui)軌(gui)(gui)(gui)(gui)道(dao)(dao)交(jiao)(jiao)(jiao)通(tong)(tong)可持續發(fa)展(zhan)所需要的土(tu)地(di)(di)(di)(di)(di)(di)保(bao)障措施(shi)。

  《辦法》規(gui)定,因軌道交通建(jian)設(she)需要(yao)進(jin)入(ru)建(jian)筑(zhu)物、構筑(zhu)物或(huo)設(she)施(shi)(shi)(shi)(shi)內進(jin)行檢(jian)測和鑒定的(de)(de),產(chan)權人(ren)或(huo)者使用人(ren)應當(dang)予以配(pei)合(he)。在(zai)青島地鐵的(de)(de)建(jian)設(she)過程(cheng)中(zhong),建(jian)設(she)單(dan)(dan)(dan)位(wei)(wei)始終(zhong) 把安(an)全(quan)生產(chan)放在(zai)第一位(wei)(wei),嚴格(ge)督(du)促(cu)施(shi)(shi)(shi)(shi)工單(dan)(dan)(dan)位(wei)(wei)采(cai)取有效措施(shi)(shi)(shi)(shi),做(zuo)到科學(xue)施(shi)(shi)(shi)(shi)工、文(wen)明施(shi)(shi)(shi)(shi)工、安(an)全(quan)施(shi)(shi)(shi)(shi)工。在(zai)施(shi)(shi)(shi)(shi)工中(zhong),建(jian)設(she)單(dan)(dan)(dan)位(wei)(wei)會同監(jian)理單(dan)(dan)(dan)位(wei)(wei)進(jin)行全(quan)天(tian)候動態的(de)(de)施(shi)(shi)(shi)(shi)工隱患排查(cha) 和生產(chan)安(an)全(quan)檢(jian)查(cha),對施(shi)(shi)(shi)(shi)工單(dan)(dan)(dan)位(wei)(wei)爆破用藥量(liang)、爆破振速(su)以及噪聲、揚塵等諸多方面嚴格(ge)管控,切實保障施(shi)(shi)(shi)(shi)工安(an)全(quan),采(cai)取各種措施(shi)(shi)(shi)(shi)減少施(shi)(shi)(shi)(shi)工對周邊環境的(de)(de)影響;同時(shi),地 鐵建(jian)設(she)單(dan)(dan)(dan)位(wei)(wei)督(du)促(cu)施(shi)(shi)(shi)(shi)工單(dan)(dan)(dan)位(wei)(wei)必(bi)要(yao)時(shi)進(jin)入(ru)周邊建(jian)筑(zhu)物、構筑(zhu)物或(huo)設(she)施(shi)(shi)(shi)(shi)內進(jin)行檢(jian)測和鑒定,力爭將可能造成居民住宅損害(hai)的(de)(de)因素降至最(zui)低。
